Acceptance of Terms

By creating an account, downloading, installing, or otherwise using the IzzaStyle App, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, which is incorporated herein by reference.

You must be at least 13 years of age, or the minimum age required by the laws of your jurisdiction, to use the Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Description of Service

IzzaStyle is an AI-powered personal styling and wardrobe management application available on iOS and Android platforms. The Service provides the following features:

• Digital Closet: Upload photos of your clothing items to build and manage a digital wardrobe. Our AI automatically analyzes and categorizes each item by color, pattern, brand, season, and occasion.
• AI Stylist “Ana”: Receive personalized outfit recommendations, style analysis, and occasion-based outfit suggestions powered by artificial intelligence.
• Body Measurement Scanning: Use your phone’s camera to capture front and side photos with pose detection for estimated body measurements.
• Style DNA Analysis: Discover your personal style preferences, fit preferences, and color preferences through AI-driven analysis.
• Daily Outfit Notifications: Receive push notifications with daily outfit suggestions tailored to your wardrobe and preferences.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Service.

Account Registration

To access certain features of the Service, you must create an account. You may register using one of the following methods:

• Email address and password
• Sign in with Apple
• Sign in with Google

When creating an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately at support@izzastyle.com if you suspect any unauthorized use of your account.

You may not create more than one account per person. We reserve the right to suspend or terminate accounts that we reasonably believe violate these Terms.

User Content

4.1 Ownership

You retain full ownership of all content you upload, submit, or transmit through the Service, including but not limited to photographs of clothing items, body scan images, and profile information (collectively, “User Content”). Nothing in these Terms transfers ownership of your User Content to IzzaStyle.

4.2 License Grant

By uploading User Content to the Service, you grant IzzaStyle a non-exclusive, worldwide, royalty-free, sublicensable license to use, process, analyze, store, and display your User Content solely for the purpose of operating, providing, improving, and maintaining the Service. This includes, but is not limited to:

• Analyzing clothing photos to categorize items by color, pattern, brand, season, and occasion.
• Processing body scan images to generate estimated body measurements.
• Using your wardrobe data and preferences to generate personalized outfit recommendations.
• Generating your Style DNA profile based on your wardrobe and stated preferences.

This license terminates when you delete your User Content or your account, except where your content has been shared with other users who have not deleted it, or where retention is required by law.

4.3 Your Responsibilities

You represent and warrant that:

• You own or have the necessary rights and permissions to upload and share your User Content.
• Your User Content does not infringe, violate, or misappropriate any third party’s intellectual property, privacy, or other rights.
• Your User Content does not contain unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable material.
• Body scan photos you upload are of yourself or are uploaded with the explicit consent of the individual depicted.

AI-Generated Content

You acknowledge and agree that:

• AI-generated outfit recommendations and style advice do not constitute professional fashion consulting, personal styling, or image consulting services.
• The AI’s analysis of your clothing, style preferences, and body measurements may contain inaccuracies or errors. Results are algorithmically generated and should be treated as suggestions, not definitive assessments.
• Style DNA analysis reflects algorithmic interpretations of your preferences and wardrobe data and should not be relied upon as an authoritative evaluation of your personal style.
• You should exercise your own judgment when acting on any AI-generated suggestions or recommendations.
• IzzaStyle is not responsible for any decisions you make based on AI-generated content, including but not limited to purchasing decisions, outfit choices for specific events, or changes to your personal style.

The quality and accuracy of AI-generated content may vary and is dependent on factors including the quality of uploaded images, the completeness of your wardrobe data, and the inherent limitations of current AI technology.

AI outputs may be biased, incomplete, or inappropriate. IzzaStyle does not guarantee the fairness, accuracy, or fitness of AI-generated content for any particular purpose. We may use aggregated and anonymised data derived from your use of the Service to improve our AI models and features; such data will not identify you personally.

Body Measurement Disclaimer

The body measurement scanning feature uses your phone’s camera and AI-powered pose detection to estimate body dimensions from front and side photographs. You acknowledge and agree that:

• Measurements are approximate and may differ from actual measurements. Accuracy depends on factors such as camera angle, lighting, clothing worn during scanning, and pose alignment.
• These measurements are not medical measurements and should not be used for medical, health, fitness, or diagnostic purposes.
• These measurements are not professional tailoring measurements and should not be solely relied upon for custom clothing orders or alterations.
• IzzaStyle is not liable for any adverse outcomes resulting from reliance on estimated body measurements, including but not limited to ill-fitting clothing purchases or inaccurate size selections.
• Body scan images are processed in accordance with our Privacy Policy and are used solely for the purpose of generating measurements and improving the Service.

By using the body measurement feature, you expressly consent to the processing of your body images and measurement data for the purposes described in these Terms and our Privacy Policy.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable local, national, or international law or regulation.
• Upload content that is obscene, offensive, hateful, threatening, abusive, or otherwise objectionable, or that depicts illegal activity.
• Upload images of individuals without their consent, or images of minors without the consent of a parent or legal guardian.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Attempt to gain unauthorized access to the Service, other user accounts, or any systems or networks connected to the Service.
• Use automated scripts, bots, crawlers, or other automated means to access or interact with the Service without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service, its servers, or connected networks.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App or any of its AI models or algorithms.
• Use the Service to build a competing product or service, or to benchmark the Service for competitive purposes.
• Remove, alter, or obscure any proprietary notices, labels, or marks on the Service.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing User Content, suspending or terminating the offending user’s account, and reporting violations to law enforcement authorities.

Intellectual Property

The Service and its original content (excluding User Content), features, functionality, and underlying technology are and shall remain the exclusive property of IzzaStyle and its licensors. This includes, but is not limited to:

• The IzzaStyle name, logo, and all related branding, trademarks, and trade dress.
• The App’s user interface, design, layout, and visual elements.
• All AI models, machine learning algorithms, and data processing pipelines used to power the Service, including the AI stylist “Ana.”
• All software, code, and technical infrastructure underlying the Service.
• Documentation, tutorials, and other written materials provided as part of the Service.

The Service is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use.

Third-Party Services

The Service integrates with and relies upon certain third-party services to deliver its functionality. These include, but are not limited to:

• Cloud Services: Cloud infrastructure providers for data storage, hosting, authentication, and content delivery.
• AI Services: Third-party AI and machine learning services used to power outfit recommendations, clothing analysis, style advice, and the AI stylist “Ana.”
• Push Notifications: Third-party services for delivering push notifications to your device.
• Apple and Google: Single sign-on (SSO) authentication and app distribution through the App Store and Google Play Store.

Your use of these third-party services is subject to their respective terms of service and privacy policies. IzzaStyle is not responsible for the practices, content, or availability of third-party services. We do not warrant or make any representations regarding the accuracy, reliability, or quality of any third-party services.

In particular, you acknowledge that certain User Content (such as clothing descriptions and style preferences) may be transmitted to third-party AI service providers for processing. Such transmissions are governed by our Privacy Policy and the third party’s applicable terms and policies.

Termination & Account Deletion

10.1 Termination by You

You may stop using the Service and delete your account at any time through the account settings within the App, or by contacting us at support@izzastyle.com. Upon account deletion:

• We will delete or anonymise your account and all associated data, including your digital closet, clothing photos, body scan images, measurement data, Style DNA profile, and preference data, in accordance with our data retention policies. We aim to complete deletion within 30 days, though some data may persist in encrypted backups for a limited period before being purged through our regular backup rotation cycle.
• Once deletion is complete, it is irreversible. We cannot recover your data after it has been removed.
• Deletion of data from third-party service providers will be carried out in accordance with our data processing agreements and their respective retention policies.
• We may retain certain data for a longer period where required by law, to resolve disputes, or to enforce our agreements.

10.2 Termination by Us

We may suspend or terminate your access to the Service, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms.
• Conduct that we determine, in our sole discretion, is harmful to other users, the Service, or third parties, or that exposes IzzaStyle to legal liability.
• Extended periods of inactivity.
• Requests by law enforcement or other government agencies.

10.3 Effect of Termination

Upon termination of your account, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, and indemnification obligations.

Indemnification

You agree to indemnify, defend, and hold harmless IzzaStyle, its owner, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service or any activity under your account.
• Your User Content, including any claims that your User Content infringes, violates, or misappropriates any third party’s intellectual property, privacy, or other rights.
• Your violation of these Terms or any applicable law or regulation.
• Your negligent or wilful misconduct.
• Any unauthorised use of the Service through your account, whether or not authorised by you.

This indemnification obligation will survive the termination or expiration of these Terms and your use of the Service.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall IzzaStyle, its owner, affiliates, partners, suppliers, or licensors be liable for:

• Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
• Any damages arising from your use of or inability to use the Service.
• Any damages arising from any content obtained from or through the Service, including AI-generated outfit recommendations, style advice, or body measurement estimates.
• Unauthorized access to or alteration of your transmissions or data.
• Any third-party conduct or content on or accessed through the Service.
• Any purchasing decisions made based on AI-generated recommendations.

In no event shall IzzaStyle’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of (a) the amount you have paid to IzzaStyle in the twelve (12) months preceding the claim, or (b) ten thousand Indian rupees (INR 10,000).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, IzzaStyle expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Service will be uninterrupted, timely, secure, or error-free.
• Any warranty regarding the accuracy, reliability, or completeness of AI-generated content, including outfit recommendations, style analyses, and body measurement estimates.
• Any warranty that defects in the Service will be corrected.
• Any warranty that the Service or the servers that make it available are free of viruses or other harmful components.

You acknowledge that you use the Service at your sole risk and discretion. No advice or information, whether oral or written, obtained from IzzaStyle or through the Service shall create any warranty not expressly stated in these Terms.

Paid Features

IzzaStyle is currently offered as a free service. If we introduce paid features, premium subscriptions, or in-app purchases in the future, additional terms relating to pricing, billing, refunds, and cancellation will apply. We will notify you of any such changes and provide the applicable payment terms before any charges are incurred.

Your use of paid features, if and when offered, will constitute acceptance of the additional payment terms. We will not charge you without your prior affirmative consent.

Service Availability

We strive to maintain the availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, upgrades, server issues, or circumstances beyond our control.

We will make reasonable efforts to notify users in advance of planned downtime. We shall not be liable for any loss or inconvenience caused by the unavailability of the Service.

Dispute Resolution

16.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at support@izzastyle.com and attempt to resolve any dispute informally. We will endeavour to resolve the matter within thirty (30) days.

16.2 Binding Arbitration

If the dispute cannot be resolved informally, either party may elect to resolve the dispute through binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible. Arbitration shall be conducted in accordance with applicable arbitration rules and shall take place in India.

16.3 Class Action Waiver

You agree that any disputes will be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding. This provision does not apply where prohibited by applicable law.

Force Majeure

IzzaStyle shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power failures, internet or telecommunications failures, cyber-attacks, and third-party service provider outages.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the “Effective Date” at the top of this page and take reasonable steps to notify you, which may include:

• Posting a notice within the App.
• Sending a push notification through the App.
• Sending an email to the address associated with your account.

For material changes that significantly affect your rights or obligations, we will provide at least thirty (30) days’ notice before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and delete your account before the changes take effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

Subject to the Dispute Resolution section above, any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be submitted to the exclusive jurisdiction of the courts of India.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
